As reported back in January, U.S. Citizenship and Immigration Services (USCIS) on Friday, January 31, 2020 introduced a new version of Form I-9, Employment Eligibility Verification, for all new hires. This new form takes effect on May 1, 2020. The new form is available here and on the electronic E-Verify program and most other electronic Form I-9 software programs.

The prior version of Form I-9 with a version date of (Rev. 07/17/2017 N) will no longer be accepted after today, April 30, 2020. We advise all employers to begin using the new form version immediately. The new form reflects a version date of (Rev. 10/21/2019).

As a reminder, employers do not need to complete the new form version for current employees with a properly completed form already on file, but should use the new form for any I-9 requiring re-verification. Employers who do not use the new beginning May 1, 2020 Form I-9 may be subject to fines in the event of an audit, under section 274A of the INA.
