The Michigan government is in the process of reviewing several proposed bills which would provide immunity from liability for claims alleging exposure to COVID-19. A precondition for receiving immunity from liability would be the compliance with federal or state statutes or regulations, executive orders or other public health guidance as applicable at the time of the exposure to COVID-19.

The proposed legislation will have a retroactive effect and provide immunity in qualifying circumstances and allow immunity to an exposure to COVID-19 that occurs after March 11, 2020.

However, immunity would not be available in situations where there was not compliance with federal or state statutes or regulations, executive orders or other public health guidance as applicable at the time of the exposure to COVID-19, if the exposure was a result of a deliberate act intended to cause harm, or if the exposure was caused by a reckless disregard of a substantial and unnecessary risk that a person would be exposed to COVID-19.
