Kitch Attorneys Laura Witty and Katharine Gostek successfully challenged and prevailed in their appeal of a Wayne County trial court’s denial of defendants’ motion for summary disposition regarding future lost earnings and lost household services in plaintiff’s wrongful death action. In an unpublished opinion, the Michigan Court of Appeals held that the trial court erred and the infant decedent’s claim for future earnings and lost household services was impermissibly speculative.

Laura Witty concentrates her practice on professional medical negligence cases including birth and perinatal injury, complex catastrophic and other neurological claims. She has extensive experience representing Michigan hospitals, physicians and other healthcare professionals in birth injury-related cases, as well as other types of medical malpractice claims. Ms. Witty is a long-time member of the Firm’s birth trauma national coordinating counsel team and has served as a consultant on birth trauma and other catastrophic claims around the country for major hospital systems, national insurance companies and excess carriers.

Katharine Gostek is an associate principal in the firm’s Detroit office. She focuses her practice on appellate law. Ms. Gostek was named a Rising Star by Super Lawyers in 2022.
