On May 3, 2018, Mike Walsh and Nick Alsaka received a defense verdict in a medical malpractice trial in the Circuit Court of Cook County before Honorable Judge Thomas Lyons, II. The trial lasted over three weeks. Plaintiff’s counsels argued that our client's emergency medicine physicians were negligent and caused the death of a 42 year old mother of one adult child by failing to diagnose and treat sepsis and toxic shock syndrome. The hospital where the doctors worked and a nurse were also named defendants. Prior to trial, Plaintiff’s demand was $7 million and no offer was made on behalf of the doctors. Seventeen experts took the stand and addressed issues ranging from the standard of care to sepsis, toxic shock syndrome and myocarditis. At trial Plaintiff counsel asked the jury for $11 million. The jury deliberated for three hours and returned a unanimous defense verdict.
