John Wasung and Anne Brossia Win Defense Verdict in Medical Malpractice Catheter Placement Case

March, 2017

John Wasung, Anne Brossia

On March 10, 2017, Anne Brossia and John Wasung of the Toledo office, received a defense verdict on behalf of their client in the Lucas County Court of Common Pleas.  This case involved allegations of medical negligence in the placement of a central venous access catheter and port, just prior to the performance of a radical modified mastectomy.  There was no blood return upon placement of the line, and it was later found to be located in the pleural space. The port was to be utilized six weeks later for the administration of chemotherapy.  Just prior to the administration of chemotherapy, no blood return was received from the port.  A port dye study was performed, which was misinterpreted by the radiologist who cleared it for use.  Plaintiff received two cycles of chemotherapy through the port before the catheter was found to be in her pleural space, resulting in pleural scaring and alleged lung damage.  The jury found no negligence on the part of our client.
